When you access our website, seek to contact us through the site or place an order, PLANET ELEMENTS SAS may collect a certain amount of information and data that directly or indirectly identifies an individual, such as first and last name, or an IP address or registration number ("Data"). The use of this Data by PLANET ELEMENTS SAS depends in particular on your browsing activity on the site.

As a reminder, Data processing refers to any operation carried out, directly or indirectly, with Data, including but not limited to: collection, recording, storage, modification, use, dissemination, or deletion.

Data collected when you contact us via the website is not stored in a database and is transmitted by email only. These emails are retained by PLANET ELEMENTS SAS solely for the time corresponding to the purpose of collection, which shall not in any case exceed 12 months.

Furthermore, data processing must be based on a legal basis such as the legitimate interest of PLANET ELEMENTS SAS, compliance with a legal obligation, or your consent.

Data collected

PLANET ELEMENTS SAS collects Data either directly from you (for example, when you contact us via the website) or indirectly through third parties (websites, third-party cookies, etc.). If you browse this site, PLANET ELEMENTS SAS may collect the following Data:

• The domain name from which you connect;
• The date and time at which you accessed our website;
• The IP address of your device / connection tool on the website.

If you send PLANET ELEMENTS SAS an information request or an email and you identify yourself by providing identification data such as your email address and a mobile number, this Data will be used in particular to respond to your message and to send you commercial messages or communications from our company.

Order and payment data

When you purchase Planet Packs™ on the site, additional Data is processed: company name, contact first and last name, email address, billing address, intra-EU VAT number where applicable, and the details and amount of the order.

Payment is handled by Stripe, our payment provider, on its own secure pages. PLANET ELEMENTS SAS never has access to your bank card number and does not store it. We receive only the payment confirmation and the billing data needed to issue the invoice and track the order.

Legal bases for processing

• Performance of the contract: processing your order, issuing the certificate, access to tracking tools and customer relationship management.
• Legal obligation: issuing and retaining invoices and accounting records.
• Legitimate interest: site security, aggregate audience measurement, and prospecting business customers about similar products.
• Consent: placement of non-essential cookies and sending commercial communications where consent is required.

Use of collected Data

We may use the information we collect from you when you visit the website or use certain other features of the site in the following ways:

• To personalise the user experience and enable us to provide the most relevant type of content and offers for you.

Nevertheless, the transmission of Data over the Internet is not without risk; consequently, PLANET ELEMENTS SAS does not guarantee the security of data transmitted over the Internet.

Data retention period

Your Data is processed only to the extent strictly necessary to achieve the purposes set out above. Once their use is no longer necessary or their retention is no longer relevant for the processing in question, PLANET ELEMENTS SAS permanently deletes them from its systems and registers and/or takes the necessary measures to anonymise them so that their use no longer allows you to be identified. In addition, anonymised data may be retained without time limit.

As an indication, the following retention periods apply:

• Messages received via the contact form: the Data is not stored in a database and is transmitted by email only. These emails are retained for the time corresponding to the purpose of collection, which shall not in any case exceed 12 months.
• Order data and accounting records: 10 years from the end of the financial year, in accordance with accounting and tax obligations.
• Commercial prospecting data: 3 years from your last contact.
• Cookies and trackers: see the duration specific to each cookie in section 3.

2. Third parties

We do not sell, exchange or transfer in any way to third parties the information that allows you to be personally identified.

For certain purposes identified above, PLANET ELEMENTS SAS uses service providers such as IT providers (e.g. the hosting provider). These providers may need to access the Data in order to fulfil the mission entrusted to them by PLANET ELEMENTS SAS.

The subcontractors involved are in particular:

• Stripe — payment processing and invoicing.
• Mailjet — delivery of emails sent from the contact form.
• o2switch — website hosting, in France.
• Google Analytics — audience measurement, set only after your consent.
• TermsFeed — management of the consent banner and preferences.

Transfers outside the European Union: some of these providers, in particular Stripe and Google, may process Data outside the European Union. Such transfers are governed by the safeguards provided for by the GDPR, in particular the European Commission's standard contractual clauses or, where applicable, an adequacy decision.

Furthermore, PLANET ELEMENTS SAS reserves the right to use third-party software to count the number of visits made to the various pages of the site, and to analyse browsing in order to identify any technical performance issues.

More generally, you have the following rights: the right of access, rectification, erasure, restriction of processing, objection and data portability, as well as the right to withdraw your consent at any time where processing is based on it, and to give instructions concerning the fate of your Data after your death.
